Sidewalk Vending Information


As of January 1, 2019, the state legislature prohibits local authorities from regulating sidewalk vending activities, except in accordance with Senate Bill 946 (SB946). The passage of SB946 decriminalized sidewalk vending activities and prohibits the issuance of criminal citations for sidewalk vending. On June 5, 2019, the Mayor and City Council of the City of San Bernardino approved ordinance MC-1517 creating a program to regulate sidewalk vending in San Bernardino.

What is sidewalk vending?
Sidewalk vending is defined as a person who sells, offers to sell, operates, engages in or carries on a food or merchandise vending business from a pushcart, stand, display, pedal driven cart, wagon, showcase, rack or other non-motorized conveyance, or from one's person, upon a public sidewalk, property, or other pedestrian path. Sidewalk vendors are considered either roaming or stationary.
What is a stationary sidewalk vendor?
A stationary sidewalk vendor is a person who sells from a fixed location. Stationary vending is not permitted in residential areas.
What is a roaming side walk vendor?
A roaming sidewalk vendor is a person that moves from place to place and stops only to complete a transaction. Roaming vendors can operate in residential areas.
What is the fee?
The fee for the permit is $60 plus a $4 state mandated fee. If an encroachment permit is needed the total fee must be obtained from the City of San Bernardino Public Works Department.
What can I sell?
Sidewalk vendors are allowed to sell whole uncut fruit, pre-packaged food items that do not require refrigeration, general merchandise, and agricultural products (this excludes cannabis).
Can I sell items from my vehicle?
No, motorized vehicles are excluded from operating as a sidewalk vendor.
How to Apply

Determine if you will be a stationary vendor (A stationary sidewalk vendor is a person who sells from a fixed location) or a roaming vendor ( A roaming sidewalk vendor is a person that moves from place to place and stops only to complete a transaction. )

Choose a business name. If you will be using a name other than your given name or the name of your LLC or corporation, you must file a Fictitious Business Name with the San Bernardino County Clerk.

Food vendors only- Contact the County of San Bernardino Department of Environmental Heath to apply for your health permit.

Food Vendors and General Merchandise vendors- Contact the California Department of Tax and Fee Administration (CDTFA) to apply for your seller's permit.

Food Vendors and General Merchandise vendors- Must obtain General Liability insurance in the amount of $1,000,000, listing the City of San Bernardino as an additional insured.

Food Vendors and General Merchandise vendors- Must obtain an encroachment permit form the City of San Bernardino Public Works Department if operating as a stationary vendor. A site plan is required to obtain an encroachment permit.
